Terms of Use & Subscription Terms

These terms explain what ImportSmart provides, the limits of calculation and AI results, how Premium plans renew, and how a recurring subscription can be cancelled.

1. The ImportSmart service

ImportSmart provides informational landed-cost, customs-duty and tax estimates and logistics-risk calculations for imports into the United States, United Kingdom, Canada, Australia and New Zealand. Results depend on your inputs and on the tariff, customs and carrier information available to the service.

These Terms govern use of the website, calculator, Premium features, AI helper and related subscription access. If you do not agree, do not use the service.

2. Results are estimates, not professional advice

ImportSmart results are informational estimates. They are not a customs ruling, binding freight or terminal quote, tax determination, or legal, accounting, customs-broker or other professional advice.

Before acting, verify classification, origin, customs value, preference eligibility, duty and tax rates, special measures, carrier or terminal charges, dates and contract terms with the relevant authority, carrier, terminal and a qualified adviser.

3. You are responsible for your inputs

You are responsible for the accuracy and completeness of all information you enter, including product or tariff code, description, origin, destination, value, currency, quantity, freight, insurance, Incoterms, transport mode, carrier, route, port, terminal, container type, dates, free time and any exemption or preferential-treatment selection.

Do not select an exemption, free-trade preference or special treatment unless you have independently verified that all legal and documentary requirements are satisfied.

4. Data coverage and source-status limits

Automatic calculation is used only when the relevant source and rule resolve safely. A result marked LOOKUP, PENDING, UNAVAILABLE or similar means that ImportSmart did not include a verified numeric rate. It must not be treated as zero.

  • Tariffs, taxes, trade measures, exchange rates and carrier charges can change without notice.
  • Negotiated rates, customer contracts and shipment-specific exceptions may differ.
  • Not every product, origin, carrier, port or terminal combination is covered.
  • Preferential treatment requires separate verification of rules of origin and supporting documents.

5. Premium access and eligibility

Premium entitlement is tied to the payment email verified with a six-digit code and to an eligible Stripe payment or an active or trialling subscription. You may optionally enable Authenticator two-step verification. If you enable it, a current Authenticator code or one unused recovery code is also required for later Premium sign-in and protected subscription management. You must keep access tokens, email access, the Authenticator device and recovery codes secure and must not share, resell or abuse access.

A paused, incomplete, inactive or past-due subscription may not provide paid access. You must be at least 18 years old or the age of legal majority required to purchase a plan and use the Premium AI feature.

6. Plans, features and calculation allowances

Eligible legacy accessAccess according to the qualifying earlier payment or subscription. A one-time purchase is not described as permanent or lifetime unless its original sales terms expressly say so.

The plan page and Stripe Checkout shown at the time of purchase control the current price, billing period and included features. ImportSmart may apply reasonable limits needed for security, fair use and service stability.

7. Stripe billing and automatic renewal

Stripe processes payments. A recurring plan renews automatically for each billing period at the price and interval shown at checkout until it is cancelled. Stripe may collect applicable billing details and display taxes, invoices and the next billing date.

If payment fails or the subscription becomes inactive, paused, unpaid or otherwise ineligible, Premium access may be suspended. Updating a card does not change these Terms or guarantee collection.

8. Cancellation, end of access and refunds

Recurring subscriptions

  1. Verify the same payment email used in Stripe.
  2. Select Manage or cancel subscription.
  3. Complete cancellation in the secure Stripe Customer Portal.

Cancellation is scheduled for the end of the current billing period shown in Stripe. Access continues until that date. The Portal is configured without proration, so cancellation by itself does not create an automatic prorated refund.

One-time legacy purchases

An eligible earlier one-time payment is not a recurring subscription, is not billed again and has no subscription to cancel. An older recurring legacy subscription remains cancellable in the same way as another recurring subscription.

Refund requests

Cancellation and refund are separate. Refund requests are reviewed under the purchase terms shown at checkout and mandatory applicable law. These Terms do not limit non-waivable consumer rights. For a billing problem or if the Portal is unavailable, contact support@importsmart.net.

9. Optional AI helper

The Premium AI helper may explain site features or an ImportSmart result, but it is not an independent calculator, classifier or source of customs, tax or legal advice. AI output can be incomplete, inaccurate or unavailable. Always compare it with the calculator result and official sources.

Your question, limited recent history and selected result context are sent to Google Gemini when you request an answer. Do not submit personal, confidential, controlled or sensitive information. Third-party availability, safety filters and rate limits apply.

10. Acceptable use and service rights

You must not:

  • bypass access, plan, rate-limit or security controls;
  • share access tokens, scrape the service at harmful volume or resell access without written permission;
  • use the service to violate trade, sanctions, customs, export-control, privacy or other law;
  • upload malware, probe vulnerabilities or interfere with another user or provider; or
  • misrepresent an estimate as an official ImportSmart guarantee or government ruling.

You retain rights in information you submit. You permit ImportSmart and its service providers to process that information only as reasonably necessary to provide, secure and support the requested service. ImportSmart retains rights in its website, software, design, compilation and original content, subject to third-party data and source rights.

11. Restricted and Unsupported Goods

ImportSmart defines the categories of goods that fall outside the scope of its calculation and reporting services. ImportSmart does not provide tariff calculations, duty or tax calculations, landed-cost estimates, reports, API results, batch-processing results, or AI assistance for goods covered by this section.

  1. Tobacco and nicotine products, including cigarettes, cigars, tobacco, heated-tobacco systems and consumables, electronic cigarettes, vaping products, e-liquids, nicotine pouches, and products or accessories specifically intended for tobacco or nicotine use.
  2. Alcoholic beverages, including beer, wine, spirits, liqueurs, alcoholic cocktails, and similar alcohol-containing beverages.
  3. Cannabis and cannabinoid-related products, including marijuana, THC, CBD, extracts, oils, concentrates, edible products, liquids, seeds intended for cultivation, and products or accessories specifically intended for cannabis use, processing, or cultivation.
  4. Illegal narcotic or recreational drug products, mixtures, preparations, precursors, and products specifically intended for an unlawful narcotic purpose.
  5. Products intended for adult sexual use, including sex toys, sex dolls, erotic devices, BDSM products, pornographic goods, and other products whose primary function is sexual stimulation or adult sexual use.
  6. Products whose primary purpose or content is sexualized subject matter, or the promotion, display, or advocacy of sexual orientation, sexual identity, or gender identity as the product's primary theme.
  7. Hookahs, shishas, water pipes, hookah tobacco, bowls, bases, hoses, mouthpieces, charcoal, heating elements, and other products specifically intended for hookah use.
  8. Books, magazines, newspapers, periodicals, catalogues, and other printed publications. The only publication exception is the Bible where the product is clearly identified as an edition of the Bible.
  9. Paintings, sculptures, figurines, photographs, reproductions, posters, prints, calendars, and other visual goods that depict visible human nudity or pornographic content.
  10. Weapons, firearms, ammunition, weapon parts or regulated weapon products, explosives, explosive substances, and products intended for an explosive purpose.
  11. Playing cards or gambling cards, poker sets, casino chips, roulette equipment, slot machines, betting equipment, and other goods, devices, or services specifically intended for gambling.
  12. Counterfeit, fake, infringing replica, pirated, stolen, or otherwise clearly illicit goods.
  13. Cosmetics, including makeup, foundation, concealer, lipstick, mascara, eyeshadow, cosmetic colours or pigments, nail cosmetics, cosmetic creams or serums, perfume, and other goods clearly marketed as cosmetics.
  14. Tattooing and piercing equipment, tools, accessories, and consumables, including tattoo machines, power supplies, needles, cartridges, inks, pigments, stencil supplies, piercing guns, piercing needles, clamps, insertion tools, and related kits.
  15. Goods expressly described or marketed as carrying satanic, occult, or witchcraft symbolism or attributes. Black colour, gothic style, skull imagery, or subcultural style alone is not sufficient for exclusion without an explicit prohibited description or purpose.
  16. Women's clothing other than the following clearly identified categories: closed, opaque and non-cropped tops, sweaters or similar garments; long or maxi skirts; long or maxi dresses; and scarves or headscarves. Where the type, length, cut, or coverage is unclear, ImportSmart will not calculate the item until clearer information is provided.
  17. Televisions, smartphones, and video-game consoles of all types, including home, portable, and hybrid game systems.
  18. Jewellery and costume, fashion, or imitation jewellery of all types, including earrings, rings, bracelets, jewellery chains, necklaces, pendants, and brooches.

These restrictions apply regardless of the product name or tariff classification entered by the user. A general HS or HTS heading does not make a product eligible where its actual description, characteristics, content, or intended use places it within an unsupported category.

ImportSmart may evaluate the HS or HTS code together with the destination market, product name, full description, intended use, keywords, synonyms, alternative trade names, technical characteristics, and other available information. Certain excluded products may otherwise appear under broad headings such as plastics, silicone goods, toys, mannequins, electrical appliances, glassware, or other general categories.

Where a product clearly falls within an unsupported category, the request is assigned BLOCKED status and no calculation or report is generated. Where the information is incomplete, ambiguous, or reasonably suggests an unsupported category, the request is assigned REVIEW_REQUIRED status and no calculation is generated until the customer supplies clearer information. REVIEW_REQUIRED does not create a manual review obligation for ImportSmart staff.

The policy applies to the standard calculator, advanced calculator, Premium features, APIs, batch processing, CSV or Excel imports, AI assistance, direct server requests, all supported destination markets, all countries of origin, and all subscription plans. Client-side checks may provide an early warning, but the final decision is made by the server before any calculation.

Blocked or unresolved requests do not receive tariff rates, duty or tax amounts, landed-cost totals, partial calculation results, reports, or guidance on changing a product description or tariff code to bypass this policy.

Men's and children's clothing, supported women's clothing categories, ordinary food and non-alcoholic beverages including coffee, and electronics other than televisions, smartphones, and game consoles generally remain eligible, provided that no other restriction in this section applies.

ImportSmart may refuse or discontinue calculation and related services for any product that falls within, or reasonably appears to fall within, an unsupported category.

12. Availability, suspension and liability

The service may be updated, limited, interrupted or unavailable because of maintenance, provider outages, source changes, security risks or circumstances beyond reasonable control. ImportSmart does not promise uninterrupted availability or that every source remains current at all times.

Access may be limited or suspended where reasonably necessary to protect the service, enforce these Terms, address non-payment or comply with law. Where practical, ImportSmart will provide notice and an opportunity to resolve the issue.

To the maximum extent permitted by applicable law, ImportSmart is not responsible for decisions made solely from an estimate or AI response, or for indirect or consequential loss resulting from inaccurate inputs, changing official rules, third-party data, carrier terms or service interruption. Nothing in these Terms excludes liability or rights that cannot legally be excluded.

13. Changes, questions and support

ImportSmart may update the service and these Terms. The date at the top will change, and material changes will be communicated where required. Changes do not retroactively remove mandatory rights.
